SPORTS WAIVER

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT
(hereinafter referred to as the “Release Agreement”
BY SIGNING THIS DOCUMENT YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT
TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT
PLEASE READ CAREFULLY!

TWO PEAKS FITNESS INC. dba TWO PEAKS FITNESS SPORTS LEAGUES (to be referred to as “organization”) and its (their) directors, officers, employees, instructors, guides, agents, representatives, independent contractors, subcontractors, suppliers, sponsors, successors and assigns (all of whom are hereinafter referred as “the Releasees”)

“SPORT ACTIVITIES”: Youth Basketball (to be referred to as “SPORT” in this document)

DEFINITION

In this Release Agreement, the term “SPORT” shall include all activities, events or services provided, arranged, organized, conducted, sponsored or authorized by the Releasees and shall include, but is not limited to: “SPORT”; “SPORT” rental; orientational, and instructional courses, seminars and sessions; travel, transport and accommodation; and other such activities, events and services in any way connected with or related to “SPORT”.

PROTECTIVE EQUIPMENT

I have been advised to wear all protective equipment that is required by the rules and regulations of the governing body for my sport.

ASSUMPTION OF RISKS

I am aware that “SPORT” involves many risks, dangers, and hazards. The risks, dangers and hazards, including but not limited to: loss of balance; difficulty or inability to control one’s speed and direction; variation or steepness in terrain; rapid or uncontrolled acceleration on hills and inclines; mechanical failure of equipment; variation or changes in the playing surface including rocks, gravel; changing weather conditions; exposure to temperature extremes or inclement weather; travel or transport to and from the sites used for “SPORT”; travel on highways and backcountry roads; encounters with domestic and wild animals including dogs, bears and cougars; collision with pedestrians, motor vehicles, cyclists and other players; failing to play safely or within the limitations of one’s own abilities, negligence of other participants; and NEGLIGENCE ON THE PART OF THE RELEASEES, INCLUDING THE FAILURE ON THE PART OF THE RISKS RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF “SPORT”.

I AM AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH “SPORT” AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS RESULTING THEREFROM.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

In consideration of the RELEASEES agreeing to my participation in “SPORT” and permitting my use of their services, equipment and other facilities, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I hereby agree as follows:

  1. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against the RELEASEES AND TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury, including death, that I may suffer or that my next of kin may suffer, as a result of my participation in “SPORT” DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, ON THE PART OF THE RELEASEES, AND FURTHER INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN “SPORT” REFERRED TO ABOVE;
  2. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES for any and all liability for any property damage, loss or personal injury to any third party resulting from my participation in “SPORT”;
  3. That I have medical insurance coverage and will show proof of insurance;
  4. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity;
  5. This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the State of Colorado and no other jurisdiction; and
  6. Any claim or litigation involving the parties to this Release Agreement shall be made solely under the laws of the State of Colorado and shall be brought only in the Huerfano County Court or the District Court in and for Huerfano County, Colorado.

In entering into this Release Agreement I am not relying on any oral or written representations or statements made by the Releasees with respect to the safety of participating in “SPORT”, other than what is set forth in this Release Agreement.

I CONFIRM THAT I HAVE READ AND UNDERSTOOD THIS RELEASE AGREEMENT PRIOR TO SIGNING IT, AND I AM AWARE THAT BY SIGNING THIS RELEASE AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.

Players Code of Conduct

I will:

  1. Conduct myself with honor and dignity and treat other players as I would want to be treated.
  2. Treat my coaches, fellow players, opponents, fans and umpires with respect.
  3. Practice good sportsmanship at all times, to win without boasting, lose without excuse, and never quit.
  4. Support and encourage my teammates, and keep a positive attitude.
  5. Attend and be on time to all games, and communicate directly with the coach in advance if I am going to miss a practice or game.
  6. Understand that playing time is earned in practice.
  7. Understand that unexcused absences from practices and games may affect my role on the team.
  8. Always sprint on/off the field / court. The effect of hustle in a game is contagious and positively impacts my team and shows my opponent I will not give up.
  9. Agree to exercise self-control at all times, refraining from foul language and setting a positive example for others to follow.
  10. Follow team/league rules to ensure safe play.
  11. Not leave the bench/court to speak to my parent or guardian unless specifically authorized by the coach for a justifiable reason.
  12. Not use or possess tobacco, alcohol, or illegal or performance-enhancing drugs, as well as recreational substances.

The below signatures verify that I have read and agree to abide by this code of conduct. Consequences may include removal from practice / game, suspension, and/or removal from the team.


Parents and Guardians Code of Conduct

  1. No alcohol or recreational substances on or around the ball field/gym.
  2. Understand that playing time is not guaranteed AND that this is NOT a “Pay to Play” system. Teams will play to win to the best of their ability and for love of the game, and coaches will use team members in a fashion that will lead to a positive outcome for both team and players. Playing time is earned in practice.
  3. Respect coaching decisions regarding playing time, position and line-ups and refrain from coaching any player from the sideline.
  4. Do our best to provide our child with water or sports drinks before the game/practice starts, and discourage our child from leaving the bench/field to speak to friends/family during games or practice.
  5. Understand that unexcused absences from practices and games may affect playing time.
  6. Do our very best to have our child prepared for every game.
  7. Have our child arrive on time or early to all practices and games.
  8. Understand that communication is paramount; we will let the coach know in advance of our child’s inability to participate in practice or games
  9. Promote good sportsmanship by keeping all comments from stands during the games positive AND showing respect for my coaches, teammates, and other officials at all times.
  10. Understand that improper behavior at a game may result in a parent / guardian being asked to leave the field/gym by game official or staff.
  11. Will not approach players or coaches before, during or immediately after games and practices with anything other than support. All questions/concerns regarding players or coaches will be addressed the day after the game or practice in an atmosphere conducive to problem solving (24-hour rule).
  12. NO REFUNDS. Equipment and t-shirts are ordered based on my child's registration.

My signature verifies that I have read, understand and agree to abide by this Code of Conduct. Consequences may include removal from practice / game, suspension, and/or removal from the team.
